General rules and conditions of use of 2Mobile SMS services

1. General provisions


The terms of use of mobile services of the company 2Mobile doo (hereinafter referred to as the terms) are the conditions defined for the provision of mobile services (hereinafter referred to as the service) by the company 2Mobile doo (hereinafter referred to as the provider), Dunajska cesta 106, 1000 Ljubljana. The use of the services is also in accordance with the instructions and recommendations of the service provider and the instructions of the route provider.


2. Definitions of terms


  1. The SMS service provider is the company 2Mobile doo.
  2. The service subscriber is a company that uses the mobile services of the provider as part of the performance of its services.
  3. The service provider is the company 2Mobile doo or the client who uses the provider's mobile services as part of the provision of its services and is fully responsible for the services.
  4. The providers of the SMS message forwarding route are Telekom Slovenije, dd/ A1, dd/ Telemach, dd/T-2 doo
  5. Content - content that the service provider provides to service users through its system.
  6. The general terms and conditions of use of the digital mobile public telecommunications network services of Telekom Slovenije, dd and the general terms and conditions of services of the A1, Telemach and T-2 networks apply mutatis mutandis to the use of the system (hereinafter referred to as the operator's general terms and conditions).
  7. The user of the service can be any natural or legal person who agrees to the terms and conditions of the service.
  8. A stand-alone number means a number (4333 or 6111) from which users receive SMS messages or to which users send SMS messages.
  9. The use of the service is allowed to an indefinite number of users who accept the Provider's Terms of Service published on the Service Provider's website or other media in a manner and under conditions in accordance with these terms and other instructions.


3. Access to and use of the service


The service can be used/accessed in one of the following ways:

  • The user sends an SMS message to a separate number with the service keyword and code for the service they want to use or register for.
  • The user confirms their agreement to the rules and terms of use of the service via SMS.


4. Types of services


A) SMS notification "FIRST"

1. Introductory provisions


These terms and conditions determine the method of implementing the service "PRVA receiving short text messages SMS" (hereinafter: SMS service), which enables receiving information about the balance on the personal savings account of the supplementary pension insurance and the investment account of the insurance company's clients. The condition for using the SMS service is that the user agrees with the subject Terms and Conditions and rules for using the PRVA service (hereinafter: general terms and conditions), which are published and accessible to the user at all times on the website www.prva.si. It is deemed that by registering for the SMS service, following the procedure described below, the user is aware of these terms and accepts them.


2. Telecommunications provider


For the transmission of short text messages, 2Mobile doo, Dunajska cesta 106, 1000 Ljubljana, registration number 6125123000. The user of the service can be any natural person who is insured by the provider and has joined the service or agrees to these terms. The SMS service can be used by users of the A1 Slovenija, Telekom Slovenije, Telemach, T-2 and other operators that support the service.

 

3. SMS service


a) Subscription to the service The user has two ways to subscribe to the SMS service: by sending an SMS message or by subscribing to the service on the moja Prva web portal.


  • To register for the SMS service by sending an SMS message, it is necessary to send an SMS message with the keywords FIRST REGISTRATION TAX POLICY to the number 6111, where TAX is your tax number and POLICY is one of your valid insurance policy numbers concluded with the insurance company. If the user has provided correct data, the service provider will respond with a free SMS message in which it will inform them of the basic data about the service, provide instructions for ordering the service and direct them to the general terms and conditions of the SMS service. The user who accepts the general terms and conditions responds to the provider's message with the text FIRST YES TAX NUMBER. After confirming the general terms and conditions, the user is enabled to receive messages. The provider ensures that any errors when placing an order for the SMS service are detected by checking the correctness of the tax number and policy number. The user will receive an SMS message about the error if there is a data mismatch and will be provided with information on how to correct the error.


b) The user can also use the moja Prva web portal to register for the SMS service. On the website, under the "Profile" tab, it is necessary to indicate that they wish to subscribe to the SMS service. They must also enter their phone number in the box provided for this. If the provider already has it, it can pre-fill it, which reduces the possibility of errors when entering the phone number for the SMS service order. When ordering the SMS service through this channel, the provider will send the user a notification in the moja Prva web portal mailbox about the successful activation of the service.

 

4. Service implementation


Once a month, the provider generates a message with information about the balance of a personal savings and/or investment account from the database and sends it via SMS to users who have subscribed to the SMS service. The provider will provide the user with information about the balances of all personal savings accounts of supplementary pension insurance, as well as investment insurance accounts, in one SMS message. On the moja PRVA portal, the user has all messages that have been exchanged (under his tax number).

 

5. Price list


Incoming SMS message: The user receives an SMS message from the number 6111 once a month with information about the balance on the personal savings account, which is charged to the user at a price of EUR 0.29 (price including VAT). The messages that the provider sends to the user during the SMS service registration process are free of charge for the user.


6. Logout


The user is always given the option to unsubscribe from the SMS service they have subscribed to, thereby waiving the general terms and conditions in question. Unsubscribing can be done through two channels and does not depend on the channel through which the user subscribed to the service:


a) The user sends an SMS message with the content: FIRST DE-REGISTRATION TAX NUMBER to 6111.


b) The user in the moja Prva web portal, under the "Profile" tab, indicates that he does not want to receive SMS service notifications. In response to the request to unsubscribe, the user receives a free return message to the mailbox on the moja Prva web portal. The unsubscribe is carried out at the same moment the user submitted the unsubscribe request.

B) SMS parking ParkMeWise


The provider of the telecommunications channel for SMS forwarding is 2Mobile doo, Dunajska cesta 106, 1000 Ljubljana, registration number 6125123000.

 

The subscriber is an individual parking lot operator and subscriber of the PARKMEWISE service who has concluded a contract with the provider for the implementation of the PARKMEWISE service, namely for the purpose of providing the PARKMEWISE service to users in parking lots under its management.

The User is a user of the PARKMEWISE service.

 

Mobile Operators are Telekom Slovenije, A1 Slovenija, Telemach, T-2 and MegaTel.

 

1. Terms of use of the PARKMEWISE SMS parking service


a) General

  • The Provider provides the PARKMEWISE service in parking lots, the list of which is published on the website www.parkmewise.com from time to time. The parking lots are managed by individual subscribers (e.g. municipalities, utility companies, etc.) and the Provider assumes no obligation or liability in relation to the parking lots. The Provider is solely responsible for the operation of the PARKMEWISE service, only to the extent and under the conditions specified in these general terms and conditions.
  • The use of the parking lot is paid by the user in accordance with the parking price list, as determined and published by the client from time to time. The provider does not charge users any compensation or costs for using the PARKMEWISE service.
  • The user is obliged to use the PARKMEWISE service in accordance with the general terms and conditions, the provider's instructions, applicable regulations and in a manner and content that are consistent with the purpose for which the provider provides the PARKMEWISE service. In the event of a violation of these general terms and conditions, the user - the violator - is liable to the provider, the client and third parties for all damage incurred, and the provider has the right to disable the user's further use of the PARKMEWISE service.
  • The provider makes every effort to provide accurate and up-to-date data within the PARKMEWISE service. If, despite the provider's efforts, an error occurs in the publication of data, the provider will do everything in its power to correct the error in the publication of data as soon as possible.
  • The provider makes every effort to ensure the availability of the PARKMEWISE service and its uninterrupted operation. If, despite the provider's efforts, the PARKMEWISE service is unavailable or there are disruptions in accessing the PARKMEWISE service or disruptions in using the PARKMEWISE service or errors in the operation of the PARKMEWISE service, the provider will do everything in its power to ensure the uninterrupted operation of the PARKMEWISE service again, but it assumes no liability for this.

 

2. How to use the PARKMEWISE service


a) The user may use the PARKMEWISE service in the manner described on the provider's website or in the PARKMEWISE application. To use the PARKMEWISE service, the user must:

  • have an appropriate mobile device that allows the use of SMS communication or access to the internet,
  • meet all other technical conditions required to use the PARKMEWISE service and
  • act in accordance with the general terms and conditions, the provider's instructions, applicable regulations, and in a manner and content that are consistent with the purpose for which the provider provides the PARKMEWISE service.


b) In the event of a violation of these general terms and conditions, the violating user is liable to the provider, the client and third parties for all damage incurred, and the provider has the right to prevent the user from further use of the PARKMEWISE service.

 

3. Responsibility


  1. The Provider is not responsible for the content available on the Provider's website or the PARKMEWISE application, or for the services available to users through the PARKMEWISE service. The Subscriber is responsible for the content available on the Provider's website or the PARKMEWISE application, or for the services available to users through the PARKMEWISE service.
  2. The Provider is not responsible for the content accessible through the PARKMEWISE service and has no control over this content.
  3. The provider is not responsible for any loss or misuse of data that the user provides to the provider or subscriber, or for any damage that may arise from this.
  4. The provider is not liable for any damage incurred by the user due to the loss or misuse of their data.


4. Rights and obligations of the contractor


  1. The contractor is obliged to provide the service professionally and with high quality.
  2. The Contractor is obliged to ensure the uninterrupted operation of the services to the greatest extent possible.
  3. The provider is obliged to inform the user about changes to the terms of use of the service. Changes to the terms are considered valid after the expiry of a period of 15 days from the date of publication on the provider's website. Prior notices of changes to the terms are published on the provider's website, to which the user is referred by SMS message. The user is responsible for correctly entered data and ensures that all data provided when registering for the service is true, correct and complete.
  4. The Contractor does not assume liability for any damage resulting from the use or non-use of the service.

 

5. Limitations


  1. Use of the service is permitted only in accordance with the rules and terms of use set by the provider.
  2. The user may not use the service for purposes that are contrary to the law or that could harm the provider or third parties in any way.
  3. The operator reserves the right to prevent any user who violates these terms from further using the service.

 

6. Final provisions


  1. These terms and conditions are valid from the date of publication on the provider's website.
  2. The court in Ljubljana is competent for the interpretation of these terms and conditions and the resolution of any disputes arising from them.
